A last will and testament is a legal document that specifies how your assets will be distributed after death, names guardians for minor children, and designates an executor to carry out your wishes. In Illinois, a valid will must be in writing, signed by you, and witnessed by two adults who won’t inherit under the will.
At Dracheva Law, we create customized wills that reflect your unique family situation and goals. Without a valid will, Illinois intestacy laws determine who inherits your property—which may not align with your wishes and can create unnecessary conflict for your loved ones.
Straightforward wills for individuals and couples with clear distribution wishes and uncomplicated family situations
Legal nomination of guardians for minor children, ensuring your kids are raised by people you trust if something happens to you
Customized wills for larger estates, blended families, business owners, and those with specific distribution conditions or restrictions
Amendments to existing wills reflecting life changes like marriage, divorce, births, deaths, or changes in assets or wishes
Wills designed to work with living trusts, ensuring any assets outside the trust at death transfer into it for unified administration
Comprehensive review of existing wills to ensure they remain valid under current Illinois law and still reflect your intentions
We don't use one-size-fits-all templates. Every will we draft reflects your specific family dynamics, asset situation, and goals. We take time to understand your wishes and explain your options so you make informed decisions about protecting your loved ones.
No hourly billing surprises. We offer transparent flat-fee pricing for will preparation, so you know exactly what to expect from the start. Most clients complete their will in one or two meetings with clear, predictable costs.
A will is just one piece of a complete estate plan. We ensure your will coordinates with powers of attorney, healthcare directives, and beneficiary designations to provide seamless protection for your family across all scenarios.
We discuss your family situation, assets, goals, and concerns. We explain how wills work in Illinois and identify whether additional documents like trusts might benefit your situation.
We prepare your customized will based on your specific wishes, including asset distribution, executor appointment, guardian nominations, and any special provisions you need.
We review the will with you in detail, answer your questions, and execute the document with proper witnesses and notarization as required by Illinois law.
Create Your Will Today
If you have children under 18, a will is essential. It's the only way to legally name guardians who will raise your kids if something happens to both parents.
Stepchildren, children from prior marriages, and complex family dynamics require careful planning to ensure everyone you love is protected and treated fairly.
Real estate doesn't transfer automatically. A will ensures your home and other property goes to the people you choose, not according to Illinois default rules.
Your will can address business succession, ensuring your company continues or transfers smoothly without disrupting operations or creating partner disputes.
Even if you want everything to go to your spouse, a will protects against unexpected scenarios and ensures your wishes are clear if you pass away together.
If you don't have a will, or your will is outdated, Illinois intestacy laws control your estate. This often creates unintended results and family conflict.
If you die without a will (called “intestate”), Illinois law determines who inherits your assets. Typically, your spouse receives a portion and your children receive the rest. If you have no spouse or children, assets pass to parents, siblings, or more distant relatives. Your wishes aren’t considered, and people you wanted to inherit may receive nothing. The court also appoints an administrator, potentially someone you wouldn’t have chosen.
At Dracheva Law, we offer flat-fee pricing for will preparation. Simple wills for individuals or couples with straightforward situations cost less than complex wills involving blended families, business interests, or special provisions. During your free consultation, we assess your needs and provide a clear quote before you commit. Most clients find professional will drafting far more affordable than they expected.
Legally, yes, but it’s risky. DIY and online wills often contain errors that make them invalid or create ambiguity leading to family disputes. Illinois has specific requirements for valid wills, and mistakes aren’t discovered until after death when it’s too late to fix them. The cost of professional will drafting is minimal compared to the cost of probate litigation over a defective will.
Review your will every 3-5 years and after any major life event: marriage, divorce, birth of children or grandchildren, death of beneficiaries or executors, significant changes in assets, or moving to a new state. Illinois law may also change, affecting your will’s provisions. We recommend periodic reviews to ensure your will still reflects your wishes and remains legally valid.
A will takes effect only after death and goes through probate court, a public process taking 12-18 months in Cook County. A trust can take effect during your lifetime, avoids probate, remains private, and provides more control over how and when beneficiaries receive assets. Many families benefit from both documents working together as part of a comprehensive estate plan.
Choose someone trustworthy, organized, and willing to serve. Your executor collects assets, pays debts and taxes, and distributes property to beneficiaries. They don’t need legal expertise, they can hire professionals, but they need good judgment and time to handle responsibilities. Consider naming an alternate executor in case your first choice can’t serve. We discuss executor selection during your consultation.
Yes, interested parties can challenge a will on grounds like lack of mental capacity, undue influence, fraud, or improper execution. However, professionally drafted wills with proper witnesses and documentation are much harder to contest than DIY wills. We take steps during drafting and execution to minimize contest risks and ensure your wishes are upheld.

Rossy has been a wonderful partner for me and my husband in figuring out all the steps involved in legacy planning. As I interviewed different attorneys for the job, I realized how rare it is to find someone that offers a comprehensive process, that yes, of course takes care of the financial part involved in estate planning, but even more understands that this is an emotional experience and there is so much more than money at stake. I immediately knew we found the right person for us when she described that she would also support us in keeping our memory alive with legacy interviews and would support us in keeping the plan updated not only financially but as we evolved as people and as a family also on the more emotional and value-driven part. If estate planning is something that scares or overwhelms you, Rossy will hold your hand all the way!Posted on Google![]()
